Terms of Use

These terms form the agreement between you and Founder Panda, the operator of GuessClash (guessclash.com — the "Platform"). By visiting the Platform or creating an account you accept them. If you do not accept them, please do not use the Platform.

1. The rights we give you

As long as you follow these terms, we grant you a limited, non-transferable and revocable right to use the Platform for personal, non-commercial purposes. This gives you no ownership over the Platform. In particular, you may not:

• copy, sell, rent out or sublicense any part of the Platform;
• reverse engineer it, or try to extract its source code or word lists;
• access it with bots, scripts or automated tools;
• place an unreasonable load on our servers, or attempt to disrupt them;
• remove or obscure any notice, branding or advertisement.

2. Who can play

You must be at least 13 years old to use the Platform. If the law where you live sets a higher age for agreeing to online services, that higher age applies. By using the Platform you confirm that you meet this requirement.

3. Your account

• Creating an account takes a single field — a name. Until you add an email address and a password, your session token is the only key to that account. If you lose the device or clear its storage, the account may become unreachable. We recommend securing it.
• You are responsible for everything that happens under your account.
• You may not sell, share or transfer your account to anyone else.
• One person should not run several accounts to manipulate the standings.
• You can delete your account at any time from your profile, or from our account deletion page.

4. Fair play and prohibited behaviour

The following will get an account restricted or closed:

• using a bot, script, automated solver or any external help during a match;
• exploiting a bug instead of reporting it;
• deliberately abandoning matches to affect ratings, or arranging results with another player;
• creating multiple accounts to inflate a leaderboard position;
• harassing, threatening or abusing other players;
• attempting to access another person's account.

5. User content and names

Your display name, username, profile photo and support messages are your content. You must not use content that is unlawful, hateful, sexual, insulting, impersonates another person or organisation, or infringes someone else's rights.

Names and photos may be reviewed automatically and by a moderator. We may reject a name, reset it to a neutral one, remove a photo, or close the account outright. By uploading content you grant us the right to display it inside the Platform for the purpose of running the service.

6. Points, badges and titles

Points, ELO, XP, levels, titles, badges, trophies and medals exist only inside the game. They have no monetary value, cannot be exchanged for money or goods, and cannot be transferred between accounts. We may adjust or reset them where a scoring error, a bug or manipulation has occurred.

7. Intellectual property

The Platform's name, logo, design, code, word lists, sounds and all other materials belong to Founder Panda or its licensors and are protected by law. Nothing in these terms transfers those rights to you.

8. Changes to the game

We develop the game continuously. Modes, rules, scoring, ad placement and features may change, be paused or be removed, and the service may be interrupted for maintenance. Where a change is significant we will announce it in the app.

9. Third-party services

The Platform uses third-party services for ads, notifications, analytics and sign-in. Their own terms and privacy policies apply to them, and we are not responsible for their content or availability. See our Privacy Policy for the list.

10. Suspension and closure

If you breach these terms we may warn you, restrict features, suspend your account or close it permanently. For serious breaches we may act without prior warning. You can close your own account at any time.

11. Disclaimer of warranties

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranty that it will be uninterrupted, error-free or fit for any particular purpose.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost data, lost profit, or the loss of in-game progress. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

13. Indemnity

If a third party brings a claim against us because of your breach of these terms or your unlawful use of the Platform, you agree to cover the reasonable costs and damages arising from it.

14. Changes to these terms

We may update these terms. The date at the top always shows the current version. If you keep using the Platform after a change, you accept the updated terms.

15. Governing law

These terms are governed by the laws of the country in which Founder Panda is established, without prejudice to any mandatory consumer protection rights you have where you live.
